The impending California regulations aimed at reducing the carbon content of fuels is being challenged in court by the Renewable Fuels Association and Growth Energy, which claim the Low Carbon Fuel Standard is counter to federal energy law and would harm the industry.
The state is seeking a 10% drop in carbon content of motor fuels sold in California by 2020. The trade groups argue that the rules are at odds with the 2007 renewable fuel standard that requires use of 36 billion gallons of biofuels by 2022. The 2007 law created greenhouse gas limits on renewable fuels, but unlike the California policy, the 2007 law exempted ethanol from plants in operation when the law passed.
In an online report this week, a spokesman for the California Air Resources Board says the industry lawsuit has no merit. The CARB spokesman says the regulation "provides California consumers with cleaner, low-carbon fuels."
