Syngenta has arrived at a successful conclusion to its patent infringement litigation against Yancheng Luye Chemical Co., Ltd and Yancheng Yongli Chemical Co., Ltd through an agreed settlement which has the backing of the Nanjing Intermediate People's Court.
Syngenta filed the lawsuit on April 19, 2004 for infringement of its Chinese patent on Thiamethoxam. Thiamethoxam is a new generation insecticide, developed and introduced by Syngenta in 1998. Under the terms of the Settlement Agreement, the Defendants Yancheng Luye and Yongli have agreed to immediately cease offering Thiamethoxam for sale. The Defendants have admitted that their offering Thiamethoxam for sale constituted an infringement of Syngenta's patent rights under Chinese law.
Yancheng Luye and Yongli have issued a written apology to Syngenta and have agreed to compensate Syngenta for its economic loss. The two Defendants will also bear the court fees.
