The future of Monsanto's Roundup Ready alfalfa seed will be considered next Tuesday when the U.S. Supreme Court hears oral arguments in an appeal that challenges a lower court injunction against its sale or planting. In 2005, USDA's Animal and Plant Health Inspection Service ruled the Monsanto product did not present a plant pest risk. The biotech seed hit the market that year.
Monsanto's senior vice president and senior counsel David Snively says similar cases have previously been stuck down. He says it's a pretty clear call.
Justice Stephen Breyer will not participate in this case. His brother was the lower court trial judge.
